Paying power can’t decide bail: Supreme Court slams Jharkhand HC | India News

NEW DELHI: Bail has to be decided by courts on the basis of nature of offence and not on the paying capacity of an accused, the Supreme Court has observed while disapproving the procedure adopted by the Jharkhand high court, which granted bail to many accused on condition of deposit of substantive sums of money without consideration of the nature of offence and also asking them to pay a hefty amount as an ad-interim victim compensation.
The apex court came across many such orders passed by the HC and said that the procedure adopted by a single judge of the court has no backing of law. In one such order, the HC had granted concession of pre-arrest bail to a man and his parents, facing prosecution for domestic violence and dowry harassment, on the condition of their furnishing a bond of Rs 25,000 and depositing a sum of Rs 7. 5 lakh as ad-interim victim compensation, thesame amount…
